HIWAY CARS, LLC INSURANCE COVERAGE APPLIES SOLELY TO RESERVATIONS THAT WERE TRANSACTED COMPLETELY ON THE HIWAY’S PLATFORM.
drivehiway.com is a peer-to-peer car sharing marketplace provided by Hiway Cars, LLC. that enables Users and Providers to engage in and transact car sharing reservation contracts for third party cars.
Hiway services include our website, web widgets, feeds, applications for third-party websites and services, and any other mobile or online services and/or applications owned, controlled, or offered by Hiway (collectively the “Platform”).
The person or entity who is using Hiway’s Platform to book a vehicle for their use is referred to as a “User”.
The person or entity who is using Hiway’s Platform to share out their vehicle to the User is referred to as a “Provider”.
“Reservation” is a car sharing contract completed on the Platform.
“Authorized Driver” and “Additional Driver(s)” are Users who are registered as drivers on the car reservation completed on the Platform, are covered by Hiway insurance for the duration of current Reservation.
“Car” means any vehicle shared via the Platform.
“you” means every Provider or User; “Hiway”, “us”, “our” and “we” refers to Hiway Cars, LLC.

Hiway Has You Covered
At Hiway, we understand just how important auto insurance coverage is to all parties involved in peer-to-peer car sharing. Therefore, Hiway is pleased to offer vehicle providers and users that meet our Provider and Vehicle Eligibility Requirements an auto insurance coverage package, as part of your Hiway service agreement. Coverage applies for the time span of each reservation, from start to finish, and includes liability, collision and comprehensive (e.g., fire, auto theft, vandalism) coverage.
Who is the Hiway Contracted Auto Insurance Carrier?
Hiway has partnered with James River, an A-rated insurance company, to provide a coverage package to our vehicle providers and users. Coverage complies with or exceeds the state minimum coverage limit requirements of each state in which we operate.
Users are covered for liability up to a Combined Single limit of $1,000,000.00 (One Million US Dollars). Coverage includes personal liability for the driver, third-party liability for passengers and other affected parties, and third-party property damage arising from a car accident.
Insurance: Comprehensive and Collision Coverage. Deductible Applies
The collision and comprehensive coverage provided protects parties in the event of an accident or other loss. It covers the vehicle against theft, fire, vandalism, weather damage, and any damage to the vehicle if an accident should occur up to the actual cash value of the vehicle (with a limit of $75,000). A $1,000.00 (One Thousand Dollars) deductible applies and will be charged to the User for all physical damage and accident claims. If User has violated Hiway’s Terms of Service, the deductible does not apply, and the User may be held responsible for the full amount of the claim.
Uninsured and Underinsured (UI/UM) Coverage
In California and New Jersey, the policy provides UI/UM limits of $15,000 per person and $30,000 per accident are provided. In New Jersey, the policy provides UM/PD limits of $5,000.
Personal Injury Protection (PIP)
PIP coverage is $15,000 in New Jersey. The User’s out-of-pocket exposure is limited to a payment of a deductible of $2,500.
Hiway Insurance is for Reservation Time Only
Although the insurance coverage provided is similar to a personal auto policy, this policy has some unique exclusions specific to Hiway’s business model. This Hiway insurance is treated as a primary insurance for all participants of the car sharing transaction (Reservation) from start to finish.
Wear and Tear Not Covered
Hiway does not insure for normal wear and tear. Normal “wear and tear” that results from the normal use of a vehicle is an inherent part of sharing or using a car. The Provider is never “protected” against normal interior and exterior wear and tear. The Provider is responsible for normal car upkeep, since all cars experience reasonable wear and tear with use. Users are not responsible for wear and tear or pre-existing damage that was reported at the start of the trip or is found to have been in place before your trip began. However, Users are fully responsible for:
any excessive wear or damage related to abuse or neglect of the vehicle.
serious damage to the inside of the car, including gouges, tears, and punctures.
any mechanical damage resulting from a guest’s negligence, intentional acts, or improper driving such as clutch damage from rough driving, suspension damage from running over speed bumps at high speed or into curbs, etc.)
Personal Belongings Not Covered
Personal belongings that Provider and/or User leave in the car are not insured by Hiway insurance. These include personal items like suitcases and handbags with their content, or any other valuables. It is the responsibility of the Provider and User to ensure they remove any personal belongings from the car when leaving.
Only Authorized or Additional Drivers are Covered
Hiway provides insurance for our registered for this particular Reservation transaction Users only. Per Hiway’s Terms of Service, only Hiway Approved Drivers may operate cars booked on the Hiway Platform, and only Authorized or Additional Users who are listed in the current Reservation transaction.
A valid “User1” books a car from a Provider. Then “User1” allows his friend “User2” (“User2” is a registered Hiway Platform User but is not listed as an additional driver in this particular reservation) to drive the provider’s car. “User2” gets into an accident. “User1” is liable, and “User2” is not covered under Hiway insurance. If “User1” and “User2” both were parties to this reservation (i.e. “User2” was listed as an Additional driver), then both of them would be covered by Hiway insurance. Only first $1,000.00 of the loss, the Deductible, is a responsibility of the User(s).
Same rules apply to other licensed drivers such as family members who were not listed as “Additional drivers” in the particular Reservation.
Cars for Personal Use Only
Insurance coverage applies to cars used for personal use only. Cars used for commercial purposes, any kind of racing, cars for hire used as taxi or Uber-like services, or stunting activity are not covered. These and similar activities are specifically forbidden and constitute a material violation of the Terms of Service, which may cause loss of insurance coverage.
Accident Must be Timely Reported. Follow the Law
Accidents that occur during a Hiway Reservation must be reported to Hiway Cars, LLC as soon as practicable, but in no event later than 24 hours of the end of the User’s reservation, by email to [email protected] . If an accident with injuries or with large property damage, or both, occurs, User must obtain a Police Report and submit a copy of said Report to Hiway or email it to [email protected] . In any accident User must follow local rules and regulations regarding such accidents in the jurisdiction where the Accident occurred.
If a claim is not reported to Hiway within 24 hours, you may forfeit Hiway Cars LLC’s insurance coverage during the trip and be solely responsible for the full cost of repairs and any losses or liability arising from the incident, unless written proof of good reason for the delay is submitted to Hiway, and Hiway in their sole decision agrees to said delay.
Owner’s Personal Auto Policy
By signing up with Hiway, Providers understand and acknowledges that their own personal auto insurance policy may not furnish coverage for the Provider or the Provider’s vehicle while the vehicle is being shared as part of the Hiway Platform. Coverage under Hiway’s insurance program shall be primary to a Provider’s personal auto insurance policy.
